Right or wrong...looking for answers according to the law

My kid never had a licence, ammo, shotgun, rifle, safety course, PAL or anything else but wanted to go hunting. It gets worse; he doesn't have a truck, gas money either. Talk about your dead-beats! The little free-loader didn't even know how to shoot, and teaching that cost more than little. Even bought some hunting properties to give him a chance. After all that he brings the meat home and since we out-number him 4 to 1 that's proof that the little poaching prick was planning on feeding us the whole time.

Not only that he gave a moose roast or 4 to his ageing grandmother. I happen to know that she gave him some birthday money and a trained ape could follow that money trail. That does it, I'm calling the cops.

Now that's funny, post of the month right there Laugh2

Up until this year we were able to buy extra tags for the controlled hunts. I would go the day they were put on sale and buy 4-6 extra tags in various group members or friends names and I would pay for them out of my pocket and the MNR cashier did not bat an eye. Reimbursement was worked out in the camp accounting or when the friend saw me next, sometimes after the deer was harvested. So what would be the difference. I have sent the wife or a buddy's daughter to buy tags when pressed for time. Supply the required info and in Wynne's World they hand you a legal tag.

My opinion(and I work in the legal business so this is not a legal opinion//advice) is there is no offence if the deer is harvested legally and gifted, as per legal definitions, to any person the legally licenced hunter should choose no matter the source of payment for the tag. I would be guilty as well for providing farmers with the greatly appreciated and expected venison sausage each year. I am sure 3 different MNR reps would have 3 different opinions.

ok, I've got the reply from my retired C.O. buddy here in MB. I have to pour my mother a glass of red wine and while I'm at the Bar, I may as well prep me a tall glass of Bar product. Oh shoot, I may have to run to town for a new box of red wine, this one is almost empty! Hang in there..........

Something to ponder while I'm gone:

Will some of us here, including me have egg on our face?

Will the pig headed OP refuse to take buddy's answer as the gospel truth and need 6 more C.O. opinion's that match?

Good day, aye! We need a question answered.

Here's the question and info:

Hunter Joe has a friend (Sally) that wants a venison for her freezer. Sally pays for Joe's hunting Lic.
Is there anything illegal about this?

Some argue that Joe is receiving money (changing hands) and this is illegal.

Some say that Joe is not profiting from this, is not selling wild game, the money go's for the hunting Lic and nothing else.

Who is right?

Thanks in advance for your reply.

Buddy's reply:

This is perfectly legit. She is paying for the license, not the animal.

so OP, there you have it from one C.O. I doubt it will be enough for you to be a firm believer, though. Hopefully other C.O.'s will chime in. I sure hope the lady gets some meat for her freezer. Good Luck hunting OP, if you decide to go.

If its good enough for you its good enough for me.

At least now I can tell her my opinion was flawed and she can "have at it"

A sincerest thank you.

Just wondering, in Quebec any big game animal taken during the hunting season must be taken to a govt approved registration station. This is for statistics compilation. Any other province do this?. If yes, kinda complicates the transfer of wild meat...yes?

naw, nothing like that in MB. Anyone can give away wild meat to anyone. Is there a law that does not allowing "giving away" in Quebec? I can't see it! Although, Quebec is Quebec!

Well then, surprise...

The scenario you have detailed can be described as bartering. The Fish and Wildlife Conservation act states:
#
Buying or selling wildlife and pelts
48.##(1) A person shall not buy or sell game wildlife or specially protected wildlife, including pelts, except under the authority of a licence and in accordance with the regulations.
“buy or sell” includes lease, barter or trade for consideration, offer to buy, sell, lease, barter or trade for consideration, or possess for the purpose of buying, selling, leasing, bartering or trading for consideration, and “buying or selling” has a corresponding meaning; (“acheter ou vendre”)

I give my kids money all the time and if he or she buys a tag to hunt deer and then puts the meat in our freezer would that still be bartering. I hope so because then I can quite paying their way like I have for the last 30 some years? Finally freedom 65.

I think the key is that if you have something good, keep your mouth shut.
