Type 97 Classification Issues - PART TWO

There's nothing to tell, really...

According to Clob (in the other Type 97 thread) the RCMP has made a decision about the Type 97, they won't tell us what that decision is, and now since CBSA is holding the rifles it is up to them to seize or release the shipment based on the RCMP decision...
 
Anyone have any idea what kind of a timeline we are looking at for waitng through the legal stuff I'm assuming CanadaAmmo may be pursuing? I've had no experience with the courts, are we talking weeks or months? Many months? How long can this stuff drag on if indeed it is going through the courts?

If it hits the courts, it will be months at a minimum, very possibly years.

If the RCMP considered it prohibited wouldn't the CBSA automatically just send the shipment back?

My "guess" is that the supplier has been paid, the rifles have "landed" in Canada and are now going through the legal grinder that the RCMP has created... I doubt very much that the "solution" would be as simple as sending the shipment back...

Its very possible, that like Marstar, CanAm has the ability to possess prohibited firearms on their license, meaning they could now get a nice pile of rifles they are not allowed to do anything with or sell to anyone.
 
so has any decision been made? Someone mentioned this is in the cbsas hands now. WTF do they have do to with it?

Either the shipment is legal, so they have to release it, or it's not.

The Tech told me that the CBSA sent some rifles "from the last shipment" to the RCMP for inspection. The RCMP made their ruling and informed the CBSA of that ruling. He said it is now up to the CBSA to make their decision regarding them.


You can speculate what the RCMP's ruling was. :cool:

I'm unsure if the CBSA has made their decision yet....only Chris would know for sure. The Tech said that he checks every day.
 
clobb- I'm guessing it's not what we wanted. If the RCMP said they're good to go, cbsa technically could not hold them. If they're prohib, cbsa can't release them, right?
