Whether or not your original mag is pinned to 5 rounds or not, it will still hold 10 rounds no problem. Due to the nature of the design of the magazine, 10 rounds fits in the space that is the inner wall of the magazine. By keeping the floorplate open, and just keeping the rounds from falling out by holding it up with your hand, you can easily load 10 rounds through the top of the rifle. Once you fire the 5th round, the magazine will have the clearance available to latch shut.
This is, (afaik) completely legal as long as there's nothing like a rubber band or other device holding the magazine for you. It also means that there's no need to modify the receiver/magwell to fit an adapter to accept a pistol magazine or another magazine intended for a bolt-action rifle.
So why all the fuss about modifying? As far as I'm concerned, We're lucky that the original design of the SKS is able to circumvent the magazine capacity limits just in its own original, stock form.
